Thank you for visiting our website https://www.milagrocenter.org/ (the “Website” or “Site”) and your interest in our mission to ensure the social and academic success of underserved children and youth through Cultural Arts, Living Values, Academic Support, and Mentoring.

The Milagro Foundation, Inc. d/b/a Milagro Center, a 501(c)(3) non-profit organization is the owner and operator of the Website, hereafter referred to in this Privacy Policy as “Milagro”, “us”, “our” or “we”.  Milagro respects the privacy of your personal information and, as such, we make every effort to ensure your personal information is protected and remains private.

For purposes of this Privacy Policy, personal information (“Your Information” or “Personal Data”) means information about you, which may be of a confidential or sensitive nature and may include personally identifiable information (“PII”) and/or financial information. PII means individually identifiable information that would allow us to determine the actual identity of a specific living person, while sensitive data may include other information, comments, content and other information that you voluntarily provide.

The term “user”, “you” or “your” refers to the visitors to our Website that wish to learn more about our programs, become a mentor to our children, make a donation or gift to Milagro, or otherwise engage with Milagro to fulfill our mission.  We have provided this Privacy Policy to explain how we collect, use, share, store and protect information about the users of our Website. We will not use or share your Personal Data with anyone except as described in this Privacy Policy. This Privacy Policy will inform you about the types of Personal Data we collect, the purposes for which we use the data, the ways in which the data is handled and your rights with regard to your Personal Data.

Milagro collects Personal Data about you when you use our Website to access our services and other online products and services from third parties that we may make available to you (collectively, the “Services”). The term Services includes the Website, services, software and technology available through the Website.

We may change this Privacy Policy from time to time. If we decide to change this Privacy Policy, we will inform you by posting the revised Privacy Policy on the Website. Changes will go into effect on the “Last updated” date shown at the end of this Privacy Policy. By continuing to use the Website or our Services, you consent to the revised Privacy Policy. We encourage you to periodically review the Privacy Policy for the latest information on our privacy practices.

By accessing or using our services, you consent to the collection, transfer, manipulation, storage, disclosure and other uses of Your Information as described in this privacy policy and our Terms and Conditions which may be accessed here (https://www.milagrocenter.org/terms/). If you do not, or no longer, agree with or consent to this privacy policy and our Terms and Conditions you may not access or use our Services.

  1. Information Gathered by Us

If you choose to register with us, you may be asked to provide personally-identifiable information (“PII”), including, but not limited to, name, address, age, business or organization name and email address.

When making a gift or donation to Milagro on this Website, you may be required to provide information on your method of payment. If you would like more information about the processing of your donation, or the secure third party payment portal, please contact us at info@milagrocenter.org.

We use and allow third parties to use cookies or web beacons to collect information about you and to provide a more tailored and user-friendly service to you. For example, we may use cookies to record session information, to record past activity or to provide better service when you return. Authorized third parties may link your name, address and email address to other information which they collect, such as past online/offline donation information and internet usage from other sites. You can set your browser to refuse cookies, but without our cookies you may not be able to take full advantage of certain features of this Site.

Session Cookies are temporary Cookies that remain in the Cookie file of your browser until you leave the Website. Persistent Cookies remain in the Cookie file of your browser for much longer (though how long will depend on the lifetime of the specific Cookie).

When you use our Services, we may employ Web Beacons (also known as clear GIFs or tracking pixels) to anonymously track online usage patterns. No Personally Identifiable Information from your account is collected using these Web Beacons.

  1. Our Use and Disclosure of Information

The information we collect about you in the course of our relationship is used to operate our Site, improve your experience on the Site and notify you about updates about Milagro. For example, we may use your PII to provide you information regarding a charitable giving program for Milagro, or to contact you when necessary. We may also use your PII to send you periodic emails about Milagro or upcoming events (“promotional email”). In addition, we look at technical information to analyze traffic to this Site, to enhance our messages and to provide targeted messages about Milagro.

We work with, and may share information with, third parties who provide services that may include, but are not necessarily limited to, website hosting, data processing and analysis, back-up and security services, and processing of credit card transactions. We may share PII with these service providers for the purpose of providing these services. Although we seek to require these service providers to protect such PII, and to use it only for the purpose for which it was provided, we cannot be responsible for third parties’ use of PII.

We may share your PII with our affiliates for marketing or other purposes. An affiliate means any company that controls, is controlled by or is under common control with us. In addition, we have built relationships with selected partners that are not affiliates, but which offer products, services or charitable opportunities that may be of interest to our users. If you opt-in to receive information from us we may also share your PII with our unaffiliated third-party partners for marketing, donation or other business purposes. Please refer to the section of this Policy titled “Opt Out,” below, if you would like to opt out of having your PII shared with affiliated or unaffiliated third parties for third-party direct marketing.

We reserve our right to share PII about our users with other third parties, including: (1) with your consent or as otherwise stated in this Privacy Policy; (2) when we have a good faith belief it is necessary pursuant to a subpoena or other judicial or administrative order; (3) where required by law; or (4) at our sole discretion, where we deem it necessary to respond to claims, to protect the safety of any individual or the public, or to protect our rights or property or the rights or property of any third party. In addition, we may share aggregated demographic and statistical information with third parties.

In the event of a change of ownership or corporate restructuring (i.e. a sale, merger, acquisition or transfer of our assets), we may share or transfer your PII to a third party.

  1. Surveys and Contests

At various times we may offer surveys or contests to users. Surveys may ask for contact information or unique identifying information to increase the value of the results. Contests may require contact information or other demographic or personally identifiable information in order to determine eligibility. We use information collected from surveys and contests to improve our service and to notify and contact winners of various contests.

  1. Third Party Websites

We do not control the information collection and distribution policies on Internet domains other than this Site. When you are on this Site, you may be directed to other sites that are beyond our control. For example, if you “click” on a link on this Site, the “click” may take you off of this Site. These other sites may independently collect data, solicit personal information, or send their own cookies to you. We are not responsible for any use of the information including click-stream data that you may create when using such third party sites.

  1. Updating or Removing User Information; Information Retention Policy

If you create an Account with Milagro, you may choose to correct or update the PII you have submitted to us by contacting us at info@milagrocenter.org. If you request to have your PII removed from your Account, we will remove it from its active database, though it may remain stored indefinitely in our back-up media and archival records.

Unless you request that we delete certain information, we retain the information we collect for as long as needed to provide you services. Following a request to delete Your Information we may retain Your Information as required by law (for example for regulatory purposes).

  1. Opt-Out

You may opt out of receiving promotional messages from us, or have Your Information shared with other entities, at any time by following the instructions in those messages sent to you, or by contacting us at any time using the Contact Us information at the end of this Privacy Policy. In doing so, you elect not to receive correspondence from us or have Your Information shared with other entities for their marketing purposes.

  1. Social Media Sharing

Our Services may now or in the future integrate with social sharing features and other related tools which let you share actions you take on our Services with other apps, websites, or media, and vice versa. Your use of such features enables the sharing of your own information (“User Content”) with your friends or the public, depending on the settings you establish with the social sharing service. Please refer to the privacy policies of those social sharing services for more information about how they handle the data you provide to or share through them. This Privacy Policy does not apply to, and Milagro is not responsible for, the User Content that you share with any social sharing services.

Any information or content that you voluntarily disclose for posting publicly to a social sharing service becomes available to the public, as controlled by any applicable privacy settings that you set with the social sharing service. Once you have shared User Content or made it public, that User Content may be re-shared by others. If you remove information that you posted to the social sharing service, copies may still remain viewable in cached and archived pages, or if other users or third parties, using the social sharing service, have re-shared, copied or saved that User Content.

  1. Offline vs. Online Practices

This Policy applies solely to our collection, use and disclosure of PII obtained online through this Website, and does not apply to any of our practices conducted offline.

  1. Changes to This Privacy Policy

This Privacy Policy may change from time to time. If we make any substantive changes to this Privacy Policy, we will notify users by posting the updated Privacy Policy on this Site. Please periodically review this page to ensure your familiarity with the current version of this Privacy Policy. Your use of this Site after the changes have been adopted constitutes your agreement with the revised Privacy Policy specifically with regard to PII collected from you in the past and in the future.

  • Security

We protect your PII using commercially reasonable technical and administrative security measures to reduce the risks of loss, misuse, unauthorized access, disclosure and alteration. Some of the safeguards we use are firewalls and data encryption, physical access controls to our data centers, and information access authorization controls. Although we take measures to secure Your Information, we do not promise, and you should not expect, that your personal information, or searches, or other information will always remain secure. We cannot guarantee the security of our information storage, nor can we guarantee that the information you supply will not be intercepted while being transmitted to and from us over the Internet including, without limitation, email and text transmissions. In the event that any information under our control is compromised as a result of a breach of security, we will take reasonable steps to investigate the situation and where appropriate, notify those individuals whose information may have been compromised and take other steps, in accordance with any applicable laws and regulations.

  1. Children’s Privacy

Our Website is designed to comply with the Children’s Online Privacy Protection Act (COPPA) and is intended for users who have attained the age of majority where they reside (18 years of age or older in most jurisdictions). Accordingly, we do not knowingly collect PII from persons under the age of 13 (the “Protected Age”). If you are under the Protected Age, please do not provide us with information of any kind whatsoever. If you have reason to believe that we may have accidentally received information from a child under the Protected Age, please contact us immediately.
